In this warranty, “LaunchPOD”, “we”, “us” and “our” refer to the entity identified above.
2. Australian Consumer Law
This warranty is provided in addition to, and does not exclude, restrict or modify, any rights or remedies available under the Australian Consumer Law or any other applicable law.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Consumer guarantees may continue to apply after the warranty periods stated below have expired. Nothing in this warranty limits the period for which a product must remain of acceptable quality under the Australian Consumer Law.
3. Warranty coverage and periods
Subject to the terms below, LaunchPOD warrants that its products will be free from defects in materials and workmanship under normal use for the following periods:
| Product or component | Warranty period |
|---|---|
| Pod body and structural components, including the structural frame, wall and ceiling structures and fixed structural panels | 5 years |
| Pod mechanical components and non-electrical mechanisms, including doors, hinges, handles, levelling components and moving hardware | 3 years |
| Pod electrical and electronic components and fittings, including lighting, ventilation fans, power outlets, switches, controllers, sensors, cables and power supplies | 1 year |
| Furniture structural elements and mechanisms | 2 years |
| Furniture stitching, upholstery, coverings and fabrics | 1 year |
The applicable warranty period begins on the date the product is delivered to the original delivery location. If the delivery date cannot reasonably be established, the date shown on the sales invoice will apply.
Where a quotation, product specification or written agreement expressly provides a longer warranty for a particular product or component, the longer period will apply.
This warranty applies to products supplied by LaunchPOD in Australia. Products described and sold as second-hand, “as is”, ex-display or floor stock remain covered by the Australian Consumer Law, but this voluntary warranty does not cover a defect that was specifically disclosed to and accepted by the customer before purchase.
4. What LaunchPOD will do
If a product develops a defect covered by this warranty during the applicable warranty period, LaunchPOD will assess the claim and, subject to the Australian Consumer Law, may:
repair the defective product or component;
provide replacement parts;
replace the product or component with the same or a reasonably equivalent product or component; or
provide another remedy agreed with the customer.
LaunchPOD will determine the appropriate remedy after considering the nature of the defect, the product, the availability of parts and the requirements of the Australian Consumer Law.
Repairs or replacements may use new or refurbished parts of equivalent function, quality and performance where permitted by law. Any replacement or substitute will be reasonably equivalent in function, although its appearance, colour or finish may vary where the original product or material is no longer available.
A repaired or replaced product remains covered for the balance of the original warranty period. This does not limit any consumer guarantees applying to the repaired or replacement product.
5. What is not covered by this voluntary warranty
To the extent permitted by law, this voluntary warranty does not cover a problem or damage caused by:
normal wear and tear or normal ageing, including reasonable pilling, fading, colour variation, stretching, softening or deterioration arising from ordinary use;
body impressions in upholstered seating measuring less than 32 mm, unless the impression results from a defect or the product otherwise fails to meet a consumer guarantee;
misuse, abuse, negligence, accident, vandalism, overloading or use outside the product’s stated load, occupancy or operating limits;
use for a purpose materially different from the product’s intended purpose or a purpose not disclosed to LaunchPOD before purchase;
improper cleaning, maintenance, handling, relocation, transportation or storage;
installation, assembly, disassembly, relocation or repair not performed in accordance with LaunchPOD’s instructions;
modification, alteration, tampering or the use of incompatible or unauthorised parts or accessories;
incorrect electrical supply, voltage, wiring or connection, power surges, or electrical work not performed by an appropriately licensed person;
exposure to direct sunlight, water, excessive moisture, corrosive substances, damaging chemicals, abnormal environmental conditions or temperatures outside the product’s specified operating range;
fire, flood, storm, earthquake or another external event beyond LaunchPOD’s reasonable control;
pest or vermin activity;
damage occurring after delivery that is not caused by a defect in the product; or
a defect that was specifically disclosed before the sale of an “as is”, second-hand, ex-display or floor-stock product.
These exclusions apply only to the extent that the excluded event caused or contributed to the claimed problem. They do not exclude coverage for an unrelated manufacturing defect and do not limit rights that cannot lawfully be excluded.
This warranty does not guarantee that an acoustic product will achieve a particular sound-isolation result unless that performance was expressly stated in the applicable quotation or product specification. Actual acoustic performance may be affected by installation, room conditions, surrounding construction and the way the product is used.
6. Installation, maintenance and relocation
Products must be installed, operated and maintained in accordance with the applicable instructions, safety information and product specifications.
Customer assembly, relocation or third-party installation does not automatically cancel this warranty. However, this voluntary warranty will not cover a defect or damage caused by incorrect assembly, installation, disassembly, relocation or unauthorised work.
Electrical installation and other regulated work must be completed by an appropriately licensed person where required by law.
7. Making a warranty claim
To make a claim, contact LaunchPOD as soon as reasonably practicable after discovering the problem:
Email: support@launchpod.design
Telephone: 03 6164 1111
Postal or delivery address: 165 Cremorne Street, Cremorne VIC 3121
Please provide:
your name, business name and contact details;
the product, model and, where available, serial number;
proof of purchase, such as an invoice, receipt, order confirmation or other reasonable evidence of the transaction;
the installation and delivery location;
a description of the problem and when it first appeared; and
photographs or video reasonably necessary to assess the problem.
An original invoice is not the only acceptable form of proof of purchase.
LaunchPOD may ask to inspect or test the product and may initially assess the claim using photographs, video or a remote service appointment. Customers must provide reasonable access to the product for inspection or repair.
Do not arrange repairs, modifications, return freight or disposal of the product without first contacting LaunchPOD, except where urgent action is reasonably necessary to prevent personal injury or further property damage, or where the Australian Consumer Law otherwise permits it.
8. Claim and transportation expenses
There is no fee for making a warranty claim.
Where a product is confirmed to have a defect covered by this warranty, LaunchPOD will bear the reasonable costs of assessment, parts, labour and any transport or collection reasonably necessary to provide the warranty remedy. Contact LaunchPOD before incurring transport or other claim expenses. Approved expenses can be claimed by providing receipts or other reasonable evidence of payment.
Where goods can be posted or readily returned, the customer may initially be asked to arrange their return. If a covered defect is confirmed, LaunchPOD will reimburse reasonable return costs.
Where goods are large, heavy, installed or difficult to return without significant cost, LaunchPOD will arrange and pay for collection, inspection or on-site assessment where required by the Australian Consumer Law.
If inspection establishes that there is no defect covered by this warranty or applicable law, LaunchPOD may charge reasonable inspection, travel or collection costs, but only after giving the customer an estimate of those costs before they are incurred.
LaunchPOD is not responsible under this voluntary warranty for unauthorised or unreasonable expenses. This does not limit a customer’s right to recover reasonably foreseeable loss or damage under the Australian Consumer Law.
9. Spare parts and post-warranty assistance
LaunchPOD will use reasonable efforts to maintain access to repair facilities and spare parts for a reasonable period, having regard to the nature and expected life of the product.
After the applicable voluntary warranty period has expired, parts and repair services may be available for purchase. The expiry of this warranty does not determine or limit any continuing rights under the Australian Consumer Law.
10. Delivery damage and acceptance
Customers should inspect products promptly after delivery and notify LaunchPOD as soon as reasonably practicable of visible damage, shortages or incorrect products. Prompt notification helps us investigate the matter with the carrier.
Signing a delivery document, using the product, paying an invoice or failing to report a problem immediately does not waive any right or remedy that cannot lawfully be excluded, including rights concerning latent or subsequently discovered defects.
11. Change-of-mind returns
This warranty deals with defective products and does not create a right to return a product because of a change of mind.
Any change-of-mind return offered by LaunchPOD is governed by the Change-of-Mind Returns section of LaunchPOD’s Terms and Conditions of Sale. A change-of-mind policy does not limit rights relating to faulty, damaged, incorrectly described or otherwise non-compliant products under the Australian Consumer Law.
12. Governing law
This warranty and any contract of sale with LaunchPOD are governed by the laws of Victoria, Australia.
The parties submit to the non-exclusive jurisdiction of the courts and tribunals of Victoria and courts entitled to hear appeals from them. This provision does not prevent a consumer from exercising a right under the Australian Consumer Law or another applicable law in a court or tribunal with jurisdiction, and does not exclude any mandatory law applying in another Australian State or Territory.
13. No unilateral reduction of warranty rights
The warranty applying to a product is the warranty in effect when the product is purchased, together with any additional written promise made as part of that sale. LaunchPOD may update this warranty prospectively, but an update will not reduce warranty rights already provided for a completed purchase.
